Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of all further proceedings pursuant to the Order and Decree dated 01-03-2021 passed in M.V.O.P. No. 327 of 2017 on the file of the Court of the Motor Accidents Claims Tribunal-cum-VIII Additional District Judge, Ongole, Prakasam District including of execution proceedings, pending disposal of MACMA No.173 of 2022, on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI P DURGA PRASAD SC FOR APSRTC Advocate for the Appellants, the Court made the following ORDER:
"For the reasons stated in the affidavit filed in support of this application and taking into consideration of the submissions made by the learned counsel for the petitioners/appellants, there shall be stay of all further proceedings pursuant to the Order and Decree, dated. 01-03-2021 passed in M.V.O.P.No.327 of 2017 by the Motor Accidents Claims Tribunal-cum-VIII Additional District Judge, Ongole, Prakasam District, subject to the petitioners/appellants depositing 50% of the awarded amount with proportionate costs and interest within eight (8) weeks from today. In default of deposit, this order stands cancelled automatically without further reference to this Court. On such deposit being made, respondent Nos.1 and 2 are permitted to withdraw their share in terms of the award by the Tribunal without furnishing any security".
