THE HON'BLE SRI JUSTICE B KRISHNA MOHAN WRIT PETITION No. 6831 OF 2020
ORDER:
Heard the learned counsel for the petitioners and the learned Standing Counsel for the 1st respondent.
This writ petition is filed for not releasing the annual grade periodical increments on the ground of discrimination as the similarly situated persons were already granted.
The learned counsel for the petitioners submits that the petitioners are working as N.M.R's in the 1st respondent office with effect from 11.11.1990 and 01.03.1889 respectively. Subsequently they were given minimum scale of pay vide proceedings Roc.No.853/1989/C1 of the 1st respondent, dated 30.04.1997 subject to outcome of the W.P.No.13359 of 1996 filed before the erstwhile combined High Court. Now that, the petitioners are seeking other benefits such as annual grade periodical increments relying upon the decision of the erstwhile combined High Court in P.khadar
Basha and others V. State of Andhra Pradesh and others<sup>1</sup>
On the other hand, the learned Standing Counsel for the 1st respondent submits that the petitioners' services were not regularised and as such they are not eligible for periodical annual grade increments. However, admits about the said proceedings granting minimum time scale of pay. It is further pointed out that no said representation of the petitioners is forthcoming with regard to the above said prayer.
Having regard to the above said facts and circumstances, the petitioners are directed to make a representation seeking for the said

relief of annual grade periodical increments, basing upon the services rendered by them enclosing with the proceedings of sanction of minimum scale of pay within two (02) weeks from today.
On receipt of the same, the respondent shall consider and dispose of the said representation as expeditiously as possible strictly in accordance with law, within a period of six (06) weeks.
Accordingly, this writ petition is disposed of.
As a sequel, Miscellaneous Petitions, pending if any shall stand closed. There shall be no order as to costs.
