Petition under Section 397(1) of Cr.P.C. is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of the judgment dated 17-02-2010 in Criminal Appeal No. 72 of 2009 on the file of the Additional Sessions Judge, Hindupur, in partly modifying the judgment dated 20-05-2009 passed in C.C. No. <sup>68</sup> of <sup>2006</sup> on the file of the Court of the Judicial <sup>I</sup> Class ^ Magistrate, Madakasira, by releasing the petitioner on bail. Pending disposal of CRLRC 319 of 2010, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the memorandum filed in support thereof and upon hearing the arguments of Sri N RANGA REDDY Advocate for the Petitioner, PUBLIC PROSECUTOR for the Respondent and the Court made the following.

The learned Judicial Magistrate of <sup>I</sup> Class, Madakasira, is directed to cause serve notice on the accused in C.C. No.68 of 2006 on its file, which case was later culminated into CrI.A. No.72 of 2009, on the file of the learned Additional Sessions Judge, Hindupur, requiring the accused to appear before this Court, failing which, the order dated 22.02.2010, suspending the sentence of imprisonment and enlarging the petitioner on bail would be recalled.
