F'etition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue <sup>a</sup> Writ or order or direction more particularly in the nature of Writ of Mandamus declaring the action of the Respondents herein particularly Respondent No.3 and <sup>4</sup> in interfering with the petitioners peaceful possession and enjoyment of the Agricultural situated at Sy.No.364 of Jaggampeta Village, Jaggampeta Mandal, Godavari District without following any of the procedure contemplated one land East

under law even without cancelling the patters allotted vide No.A6275/82, dated 06.04.1982 as nothing but illegal, arbitrary, high handed and violative of Article <sup>21</sup> and 300 A of The Constitution of India and Consequently direct the Respondents Nos. 2 to 4 not to interfere with the petitioners peaceful possession and enjoyment of the agricultural land situated at Sy.No.364 of Jaggampeta Village, Jaggampeta Mandal, East Godavari District allotted vide proceedings No. No.A6275/82, dated 06.04,1982.

Petition under Section <sup>151</sup> CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent Nos. <sup>2</sup> to 4 not to interfere with the petitioners peaceful possession and enjoyment of the agricultural land situated at Sy.No.364 of Jaggampeta Village, Jaggampeta Mandal, East Godavari District allotted vide proceedings No.A6275/82, dated 06.04.1982 pending disposal of the above writ petition.

The Court made the following order:

Aggrieved by the action of the respondents in interfering with the petitioners possession and enjoyment of the agricultural land situated in Sy.No.364 of Jaggampeta Village and Mandal, East Godavari District without following the due procedure under law, in order to allotment of the house site Pattas in favour of the beneficiaries under the Scheme Navaratnalu - Pedalandariki lllu" launched by the Government of Andhra Pradesh, the instant writ petition is filed.

Today when the matter is taken up for hearing, the learned Assistant $\overline{2}$ . Government Pleader for Revenue has placed on record a copy of the written instructions received by him in the case, wherein it is stated by the respondent No.4 that the subject land in Sy.No.364 situated at Jaggampeta Village is not proposed for house site pattas. He further submits that the contention of the petitioner that respondents are interfering with his possession and enjoyment of the subject land would not merit consideration and thus prayed for dismissal of the writ petition.

The written instructions of the respondent No.4 dated 29.11.2024 is 3. placed on record.

In view of the submissions made on behalf of the respondents the writ $\overline{4}$ petition is disposed of, as the grievance of the petitioner is resolved.

Accordingly, the Writ Petition is disposed of. There shall be no order as 5. to costs.

As a sequel, all pending miscellaneous applications shall stand closed.
