Petition under Section 151 of CPC, praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to recall the Non Bailable Warrant issued against the respondent No.2 i.e. Smt B. Udaya Lakshmi in CC.No. 512 of 2018 in C.C.No. 1275 of 2014 in W.P.No. 8811 of 2008.

WHEREAS the said case coming on for hearing, and whereas the High Court, upon perusing the affidavit filed therein and earlier orders of this Hon'ble Court dt. 06-04-2018 and 15-06-2021 made in C.C.No. 512 of 2018 and upon hearing the arguments of Sri C. Srinivasa Baba, Advocate for petitioner/respondent No.2 and of Sri J. Sudheer, Advocate for respondent No.1/petitioner, and Sri K.V. Raghuveer for respondent No.2 the Court made the following ORDER : -

"This application has been filed seeking to recall the Non-bailable warrant issued by this Court on 15.6.2021 to the petitioner herein.

Smt B.Udayalaxmi, I.A.S. (Retired), Former Commissioner of Intermediate Education, Government of Andhra Pradesh, who is respondent No.2 in this contempt case, is present before this Court.

Heard Sri C.Srinivasa Baba, learned counsel for the petitioner, and perused the averments made in the affidavit filed along with this application.

In view of the reasons stated in the accompanying affidavit, this Court is of the considered opinion that it is appropriate to recall the Non-bailable warrant issued to the petitioner on 15.6.2021.

Accordingly, I.A.No.1 of 2021 is allowed and the Non-bailable warrant issued against the petitioner/respondent No.2 on 15.6.2021 is hereby recalled in the interest of justice.
