Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in nature of Writ of Mandamus declaring the mala- fide and arbitrary action of the 5th to 8th respondents in paying the Writ petitioner, a flat Rs. 72721- salary per month to till this day by willfully disobeying the mandates of the G.O.Ms. No 151 Dated 08-08-2016 G.O.Ms. No 142 Dated 07-08-2018 G.O.Ms. No 6 Dated 17-01-2022 as illegal, arbitrary, unjust, violative of principles of natural justice as well as violative of Article 14, 16, 21, 19(1)(g), 300-A of constitution of India. Consequently, direct the 5th to 8th respondents to pay the salary arrears amounting of Rs. 11,36,456/- (Eleven Lakhs thirty-six thousand four hundred and fifty-six rupees only) as per my entitlement in pursuant to G.O.Ms. No.151 Dated 08-08-2016 G.O.Ms. No.142 Dated 07-08- 2018 G.O.Ms. No.6 Dated 17-01-2022 along with interest at the rate of 18percent p.a.in the interest of justice.

Heard Sri Mohammad Ghalib Shahib, learned counsel appearing for the petitioner, learned Assistant Government Pleader for Services-I appearing for respondent Nos. <sup>1</sup> to 3, learned Government Pleader for

Services-ll appearing for respondent Nos.4 to 6 & <sup>9</sup> and G.Srinivasula Reddy, learned Standing Counsel for ZPP and MPP appearing for respondent Nos.7 & 8.

  1. The petitioner initially joined as an Attender in Zilla Praja Parishad, Chilakalapudi, Krishna District, vide proceedings Rc.No.2409/89A7, dated 28.06.1991. She was later posted as Gardener at Zilla Parishad High School, Arugolanu, under the Class-IV employee category. From there, she was transferred to Machilipatnam, vide proceedings Rc.No.1148/2023/A7, dated 31.07.2023, issued by the 8"^ respondent. Since then, she has been continuously discharging her duties as an Attender-cum-Gardener at the office of the 8*^ respondent-Deputy Chief Executive Officer , Zilla Praja Parishad at Machilipatnam, and, upon attaining superannuation, retired from service.

  2. As she was not paid her salary from 01.03.2014 to 2023, a period of nearly nine years, she preferred W.P.No.22548 of 2022 before this Court. By virtue of an interim direction dated 18.01.2023 this Court directed the respondent authorities to pay the arrears of salary. Accordingly, the respondents paid <sup>a</sup> sum of Rs.7,70,822/-. Subsequently, as the petitioner's salary was increased in pursuance of G.O.Ms.No.151, Finance (HR-l-PIg. & Policy) Department, dated 08.08.2016, G.O.Ms.No.142, Finance (HR-I-Pig. & Policy) Department, r::.^rg

Department, dated 17.01.2022, she submitted various representations to respondent Nos.5 to 7, requesting payment of the arrears of her revised salary. However, no action has been taken by the respondent authorities, so far. Aggrieved by this inaction, the petitioner has filed the present writ petition.

With the consent of both counsels, and without going into the merits of the case, the matter is being disposed of at the stage of admission itself. The respondent Nos.4 to <sup>8</sup> are directed to consider the petitioner's representation dated 09.01.2025 in terms of the aforementioned G.Os., and pass appropriate ordfers in accordance with the law as expeditiously as possible, preferably within <sup>a</sup> period of eight (08) weeks from the date of receipt of <sup>a</sup> copy of this order. 4.

With the above direction, the Writ Petition is disposed of. 5. No order as to costs.

As <sup>a</sup> sequel thereto, miscellaneous petitions, if any pending. shall also stand closed.
