THE HON'BLE SRI JUSTICE M.GANGA RAO
CONTEMPT CASE No. 501 OF 2021
ORDER:
This contempt case is filed to punish the respondents for wilful disobedience of the order dated 27.09.2021 passed by this Court in W.P.No.14879 of 2019.
Sri T.V.S.Kumar, learned Learned Government Pleader appearing for the respondents, states that in pursuance of the order dated 27.09.2021 passed by this Court, an Endorsement dated 20.03.2021 was issued by the 2nd respondent stating thus:
"The Writ Petitioner has filed his objections after passing of Awards and payments made to the land owners identified during notifications and Award enquiry. Hence, as a Land Acquisition Officer once Award passed and payments were made, at such stage, that case cannot be reopened for enquiry afresh. Due to unknown reasons, my predecessors could not issue an order to the petitioner with an endorsement to approach the proper forum against the persons who received the compensation to the lands claimed by the petitioner. Anyhow the Writ Petitioner is hereby informed to prefer a claim before the competent forum for redressal of his claim, if so he desires and having sufficient record in support of his claim. Accordingly, the direction of the Hon'ble High Court complained."
Considering the facts and circumstances of the case, submissions of the learned counsel and on perusal of the record, this
Court found that there is no wilful and deliberate violation of the order dated 27.09.2021 passed by this Court.
Accordingly, the Contempt Case is closed. As sequel to it, Miscellaneous Applications, if any pending, shall also stand closed. No order as to costs.
