Counsel for the Writ Petitioners have also

$3.$<br>Sri V. Hemanth Kumar, Learned
Counsel representing NCTE submitted that, the
discussions and deliberations, which took place
between the APSCHE and the Universities, were
neither made known to the NCTE nor was the
NCTE called-upon to participate in the
deliberations. He submits that NCTE ought to
have been called-upon to participate in these
deliberations so that the NCTE would also

indicate its concerns during the process of discussion. It so transpired that the NCTE would hold independent inspection which is different from the inspections being held by the respective Universities. This Court has suggested that a Joint Inspection be made consisting members of NCTE as well as the respective Universities in order to prevent duplication or repetition of inspections, which are not enduring to the benefit of either of the Colleges or the Students.

  1. The paramount consideration of this Court being that the Students shall have seamless educational course in the respective Colleges, the Court has suggested that the existing system of inspections, reports, recommendations and penalties will have to be rationalized to see that, there shall be one initial inspection, which will be a Joint Inspection by the members of NCTE as well as the members of the respective Universities, and there shall be one Report reflecting the opinion/reflections of the NCTE as well as the Universities either jointly or individually. Even if the concerns of these bodies are independent, it shall be so stated in the Report, but there shall be one Report reflecting the opinion/reflections of both the expert bodies.

Counsel appearing for NCTE,<br>has sought time to
put forth the schedule submitted by the APSCHE
to the NCTE for further consideration.<br>The
NCTE, APSCHE and the Universities shall make
an<br>endeavour<br>to<br>constitute<br>one<br>Inspection
Committee (Fact Finding Committee) jointly and
submit a Report as indicated above.
6.<br>List as Part-Heard on 12.04.2023 for
further consideration.
7.<br>NCTE<br>may<br>also<br>file<br>an<br>Affidavit
expressing its<br>concerns<br>before the next date.
8.<br>Appearance of JNTU, Kakinada and
Ananthapur, is dispensed with.
9. Registry is directed to print the name of
V. Hemanth Kumar, Learned Counsel,<br>who is
Respondent No.4,<br>in all the cases.
10.<br>De-tag WP.No.17825 of 2022.
