Ram Babu, leamed Standing Counsel for Nagarjuna University and Smt.S.Parineeta, learned Standing Counsel for A.P State Council of Higher Education.

  1. This batch of Writ Petitions is coming up before the court, where admissions into B.Ed Colleges are under consideration by this court.

  2. On perusal of the Affidavits filed in several Writ Petitions, jt transpires that the schedules fixed for Inspection, the dates of Inspection, the manner in which the Inspection Committees are constituted, the Reports made by the Inspection Committees, directions issued by the universities for compliance of deficiencies vis-avis Inspection Report submitted by the Inspection Committees, re-verification by the Inspection Committees whether the deficiencies earlier pointed out in their Report are complied with or not, are all in variance from university to university. But one activI'ty is common that is in respect of admissions through common Entrance Tests.

  3. The admissions are conducted by the respective conveners. such conveners are usually appointed by Andhra Pradesh State Council of Higher Education (APSCHE). The Conveners so appointed by APSCHE fixes the time schedules for inviting Applications, conduct of common Entrance Examinations, issuance of dates for various stages of counseling etc.,.

  4. More often than not, the schedules fixed by the respective universities for Inspection of various colleges, subml'ssion of Reports, dates fixed for compliance, various schedules required for compliances of various deficiencies were all at variance from University to University.

  5. Finally, in the observation of this court, the various universities which are giving various dates/schedules in the process of Inspections and determination of Affiliations are unable to cope-up wl'th the dates issued by the respective conveners for common Entrance Examinations, as the admissions are administered commonly for all the Colleges under various universities at one time.

  6. This Court has noticed that some universities which have fallen behind in conduct of Inspections and ensuring curing of all deficiencies by the respective Affiliated Colleges, are initiating actions, detrimental to the interest of Institutions, as belatedly as being initiated just before the commencement of the admissions or otherwise. Various Orders are passed by the respective universities either under zero admission category for the academic year or reduction of class strength or complete disaffiliation. While these punitive and drastic steps are being taken on dates which are very very close to the dates announced by the conveners of common Entrance Examinations just before the admissions, these are causing not only great hardship to

the Institutions but also flooding this court with writ petitions seeking various reliefs at the nick of time.

  1. On consideration of these issues, this court has suggested to the APSCHE as we" as to the universities, in the best I-ntereSt Of Students, all the UnI-VerSitieS, under the supervision of APSCHE sha" have a common schedule for initiating the process for Inspection, whl-ch would commence with the constitution of various committees, setting dates for the committees to physically inspect the lnstI-tutiOnS, preparation and submission of Inspection Report pointing various deficiencies, grating time to the Institutions to cure the deficiencies, directing the same Inspection committee to physI'CaIIy inspect the college to verify whether the defI'CienCieS pointedout earlier were rectified or not and fI'na[[y the Universities to take a ca" whether a particular lnstitutI-On Can be granted/renewed Affl-liation for the following academic year or not. Although these exercises are conducted by the respective universities, when jt comes to the matter of adml-ssion, it is a common date which a" the Institutions affiII'ated tO Various Universities will have to follow, and therefore, there is a serious concern to see to it that a" unl'versitjes would follow one common date for each and every step that is required.

  2. This Court has also suggested to the learned counsel for writ petI'tl'OnerS aS well as the learned Standing counsel appearing for varl'ous universities and also to the learned standing counsel for the APSCHE that in order to streamII-ne the Process and in order to rationall'ze the varl'ous schedules undertaken by independent universities with that of the schedules of common Entrance Examinations that would be conducted by the convener each year, they should come out with suggest,Ions indicatI'ng Particular schedules which the respective universities would adhere to such schedules scrupulously from year to year.

  3. lt is also contemplated that adherence to one single schedule will not only bring in more orderliness in the process of Inspections and also in the process of admissions, it would also bring in more consistency in the curriculum schedule for the students whI'le Pursuing their careers. The Court suggested these aspects keeping in mind the paramount concern that it has for the students undergoing various courses and to see to it that there I'S COnSiStenCy and definiteness in every schedule.

ll. ln view of these observations made by this court, this court deems it appropriate to direct the APSCHE to ca" a meeting with the vice chancellors and

Registrars of all the Universities to discuss and come Out With a common schedule for the following:

a) For Inspections, submiss'lon of Inspection Reports po-lnting-out deficiencies, curing of such deficiencies by the respective Colleges and second physical inspection only to verify whether the defects pointed out earlier are cured or not and the final decis-Ion of the College.

b) To ensure rationalization between the schedules fixed by the Convener of common Entrance Examinations with that of final deCjS'IOn taken by the respective universities in Affil'lation or D'lsaffiliation of respective Colleges.

c) The APSCHE will also consider imposing penalties Of monetary nature in place of Disaffiliation, zero year category or reduct'lon Of Seats.

  1. The APSCHE shall file an Affidavit`withjn two weeks indicating the final outcome of final discussion. The APSCHE is .free to call the Vice Chancellors and Registrars of various Universities either for physical participation Or Online aS Per its convenience.
