THE HON'BLE SRI JUSTICE M. GANGA RAO
Contempt Case No.350 of 2021
ORDER:
This contempt case is filed under Sections 10 & 12 of the Contempt of Courts Act alleging wilful and deliberate disobedience of the order, dated 27.08.2020, passed by this Court in W.P.No.15257 of 2019.
By the said order, the Writ Petition was disposed of directing the respondent authorities to consider the petitioners' representation said to have been sent by registered post and/or call for their objections before issuing NOC or granting permission to the 4th respondent to establish petrol fuel station at S.No.237 and 238 of AIR by-pass road, Tirupati town.
This contempt case is filed inter alia stating that pursuant to the order passed by this Court, 2nd respondent caused a notice on 09.12.2020 on the petitioners calling for objections providing 7 days time, for which the petitioners addressed their objections, in detail, on 22.12.2020 and the same was received by the 2nd respondent but no action was taken on the said objections.
Pursuant to the Form I notices, when the contempt case is taken up for hearing today, respondents 1 & 2 appeared online. The 3rd respondent appeared in person.
Heard learned counsel for the petitioners, learned Government Pleader for Revenue appearing for the 1st respondent, Sri Suresh Kumar Reddy Kalava,
learned counsel appearing for the 2nd respondent and Sri O. Manohar Reddy, learned counsel appearing for the 3rd respondent.
All the respondents filed reply affidavits. A reading of all the reply affidavits reflect that pursuant to the orders passed by this Court in WP.No.15257 of 2019, respondent authorities issued notices to all concerned, conducted detailed enquiry on the objections raised by the petitioners and found that the same are baseless and there are no merits in the objection petition dated 27.09.2019 and accordingly rejected the objections vide endorsement in Rev-CSECOPAR(MIS)/1/2019 dated 16.03.2021 issued to the 4 th petitioner and copy of the same is communicated to others.
After hearing both the learned counsel and considering their submissions, this Court found that there is no willful or deliberate disobedience/violation of the orders of this Court by the respondents.
In the result, the Contempt Case is closed.
As a sequel, pending miscellaneous applications, if any, shall stand closed.
