named through Advocate WHEREAS the Petitioner above his G.V.L.MURHTY presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus the action of the respondents, particularly the respondents No.4 and 5 in issuing the transfer Order through proceedings in Rc.No.4310/B3/2020, dated 22.01.2021, transferring/posting the petitioner from MPUP School, Yathuluru. Venkatagiri Mandal, SPSR Nellore District to MPUP School, Tanayali, Doravari Satram Mandal, SPSR Nellore and accordingly in issuing the reliving order through Proceedings No.25/Transfers /2020, dated 29.01.2021 is highly illegal, arbitrary, unjust, improper, contrary the Rules framed under G.O.Ms.No.53 dated 12.10.2020, contrary to the directions of the Hon'ble High Court Orders dated 23.12.2020 and 07.01.2021 passed in WP.No.24796 of 2020 and in violation of fundamental rights guaranteed under Article 14, 16 and 21 of the Constitution of India and consequently set-aside the Transfer Order and Relieving Order vide Proceedings in Rc.No.4310/B3/2020, dated 22.01.2021 and Proceedings in Rc.No.25/Transfers /2020, dated 29.01.2021 issued by the respondents No.4 and 5, directing the respondents to retain/continue the petitioner in the present place i.e. MPUP School, Yathuluru, Venkatagiri Mandal, SPSR Nellore District.

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri G.V.L.Murhty, Advocate for the Petitioner and GP for Education for the Respodnents, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.
