WHEREAS the Petitioners above named through their Advocate Sri N Ranga Reddy presented this Petition under Section 482 of Cr.P.C, praying that in the circumstances stated in the memorandum of grounds filed in support of the Criminal Petition, the High Court may be pleased to quash the proceedings in FIR No 10 of 2022 dated 21.1.2022 on the file of PS Pamidi, Anathapuram District in so far as the petitioners herein are concerned in the interest of justice.

AND WHEREAS the High Court upon perusing the petition and memorandum of grounds filed herein and upon hearing the arguments of Sri N Ranga Reddy, Advocate for the Petitioners, Public Prosecutor for Respondent No.1, directed issue of notice to the Respondents herein to show cause as to why this CRIMINAL PETITION should not be admitted.

You viz:

Kallamadi Obulamma, W/o Late Kallamadi Gamapaiah, aged 70 years R/o Diguva Mala Street, Pamidi Town, Ananthapuram District

are directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and the memorandum of grounds filed therewith (copy enclosed) this CRIMINAL PETITION should not be admitted. IA NO: 1 OF 2022

Petition under Section 151 CPC praying that in the circumstances stated in the memorandum of grounds filed in support of the petition, the High Court may be pleased to grant stay of all further proceedings in FIR No 10 of 2022 dated 21.1.2022 on the file of PS Pamidi, Ananthapuram District in so far as the petitioners herein are concerned, pending disposal of CRLP No.1171 of 2022, on the file of the High Court.

The Court made the following: ORDER

"Notice to the respondents.

Learned counsel for the petitioners is permitted to take out personal notice to the 2<sup>nd</sup> respondent by Registered post with acknowledgment due and file proof of service into the Registry.

Based on the complaint given by the defacto complainant on 21.02.2022, a crime was registered against the petitioners in F.I.R.No.10 of 2022 on 21.01.2022 on the file of Pamidi Police Station, Ananthapuram District.

The allegation made in the complaint itself discloses that to circumvent the proceedings pending before the Junior Civil Judge, Gooty, in OS.No.42 of 2010, the $2<sup>nd</sup>$ respondent has filed the present complaint. Even according to the allegations made in the complaint also, the documents were mutated in the name of the Accused No.1 and 2 way back in the year 2017 and knowing fully well about the record, the defacto complainant has not made any appeal under the statue.

Considering the submissions made and perusal of the complaint, there shall be stay of all further proceedings in F.I.R.No.10 of 2022 dated 21.01.2022 on the file of Pamidi Police Station, Ananthapuram District."
