WHEREAS the Petitioner above named through her Advocate BADETI VENKATA RATHNAM presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the proceedings initiated by the Respondent before the Honourable Authorized Officer under the AP Special Courts Act,2016 vide Confiscation Case No.1/2018 against the petitioner, Kurnool at Vijayawada for confiscation of the properties annexed therein as illegal, arbitrary and contrary to the Provisions of Prevention of Corruption Act. 1988 and consequently declare the A.P. Special Courts Act,2016 applies to the cases only in prospective nature; IA NO: 1 OF 2019:

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant Stay of all further proceedings including appearance of the petitioner/accused made in Confiscation Case No.1/2018 on the file of the Authorized Officer, Kurnool, ACB Range. Vijayawada, pending disposal of the WP No. 3262 of 2019, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated 10/04/2019, 06/06/2019, 19/06/2019, 26/06/2019, 10/07/2019, 25/07/2019 & 08/08/2019 made herein and upon hearing the arguments of Sri BADETI VENKATA RATHNAM Advocate for the Petitioner, SRI P. UDAYA BHASKARA RAO, Special Prosecutor for ACB Cases, for the Respondent, the Court made the following.
