In the present Writ Petition, petitioner
herein, who is a retired employee in Panchayat
Raj Department, is seeking enforcement of the
order dated 19.02.2016, passed by the Andhra
Pradesh Administrative Tribunal in O.A.No.2344
of 2015. By way of the said order, the Tribunal,
while setting aside the order impugned in the
Original Application, directed the respondents to
consider the name of the applicant for pension
and pensionary benefits, including gratuity and
to release the same within four (4) months, from
the date of receipt of the order.
Subsequently,<br>while<br>referring<br>to<br>the
information furnished by the Chief Executive
Officer,<br>Zilla Praja Parishad<br>and the orders of
the<br>Government<br>vide<br>G.O.Rt.No.1797,
Panchayat<br>Raj<br>and<br>Rural<br>Development
Department,<br>dated 19.11.2013,<br>issued by the
State Government, in similar circumstances, the
Director, Panchayat Raj and Rural Development
issued<br>letter No.671402/DPR<br>&RD/C1/2015,
dated<br>05.03.2019.<br>In<br>the<br>said<br>letter,<br>the
Director also specifically stated that the Chief

Executive<br>Officer<br>submitted<br>a<br>report<br>for<br>sanction of pensionary benefits, gratuity and<br>other<br>benefits<br>to<br>the<br>petitioner.<br>Subsequently, alleging willful disobedience<br>of the order passed in O.A.No.2344 of 2015, on<br>the part of the respondents, petitioner herein<br>approached<br>this<br>Court<br>by<br>way<br>of<br>filing<br>C.C.No.1717 of 2021.<br>According<br>to<br>the<br>petitioner,<br>pending<br>contempt case, the respondents herein paid a<br>sum of Rs.35,828/- in the month of December,<br>2021. It is further stated that,<br>in view of the<br>same,<br>under the impression,<br>the respondents<br>herein<br>would<br>implement<br>the<br>order<br>of<br>the<br>Tribunal, petitioner herein had withdrawn the<br>said C.C.No.1717 of 2021 on 27.01.2022.<br>According to the learned counsel for the<br>petitioner,<br>till date,<br>no sanction orders have<br>been passed by the respondents, in the direction<br>of redressing the grievance of the petitioner.
