ORDER:

The Writ Petition is filed to declare the action of the respondents in not making payment for the works executed and recorded in Measurement Book No.1605-B/2019-2020 for laying of internal C.C. road at Essadonka ST colony of Leburu Village and Gram Panchayat of Indukurupet Mandal, SPSR Nellore District under Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) as illegal, irregular, arbitrary, violative of Articles 14, 21 and 300-A of Constitution of India and for a consequential direction to the respondents to pay the amounts with interest as per the aforesaid Measurement Book

Numbers under the MGNREGS convergence with Grampanchayat Funds, forthwith to the petitioner.

  1. At the time of considering the matter, the learned Assistant Government Pleader for Panchayatraj placed a copy of instructions received from the 4th respondent dated 23.03.2023, from a perusal of which, it would appear that an amount of Rs.5,60,206/- is due to be paid to the petitioner.

  2. In view of the above admitted position, it is deemed appropriate to dispose of the Writ Petition with a direction to the respondents to make payment of the said amount to the petitioner, as expeditiously as possible, at any rate, within a period of six (6) weeks from the date of receipt of a copy of this order. It would also be open to the petitioner to agitate his claim for interest, if any payable by the respondents, in an appropriate Forum.

  3. With the above direction, the Writ Petition is disposed of. No order as to costs.

As a sequel, all the pending miscellaneous applications, if any, shall stand closed.
