THE HONOURABLE SRI JUSTICE NINALA JAYASURYA

WRIT PETITION No.3984 of 2021

ORDER: (Heard and pronounced through Blue Jeans App(virtual) mode, since this mode is adopted on account of prevalence of COVID-19 Pandemic).

Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 to 4 and with their consent, the writ petition is disposed of, at the stage of admission.

The grievance of the petitioner in the present writ petition is that the appeal/revision vide Roc.E4/1365/2012 dated 27.02.2012 filed before the 2 nd respondent has not been disposed of so far. As seen from the notice dated 27.02.2012, it appears that in the revision petition which was filed by the 5th respondent before the 2nd respondent, hearing was proposed to be conducted on 03.03.2012.

Learned counsel for the petitioner states that according to his instructions, nothing transpired after issuance of the said notice and the matter is still pending consideration before the 2nd respondent.

The learned Assistant Government Pleader for Revenue, could not secure instructions as to the status of the proceedings allegedly pending before the 2nd respondent as the matter pertains to the year 2012.

In the said circumstances, this Court deems it appropriate to direct the 2nd respondent to take up the revision Roc.E4/1365/2012 dated 27.02.2012 and dispose of the same, in the event it is still pending, subject to maintainability and in accordance with law, after giving due opportunity to the petitioner and 5th respondent, within a period of eight (8) weeks from the date of receipt of a copy of the order.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel, all the pending miscellaneous applications in the writ petition, shall stand closed.
