The Court made the following COMMON JUDGMENT: (per NJS,J)

The Family Court Appeal No.233 of 2008 is filed by the wife against the order and decree dated 17.11.2008 in F.C.O.P. No.205 of 2008 on the file of the Judge, Family Court, Nellore, dissolving the marriage between the parties.

  1. The Family Court Appeal No.173 of 2009 is filed by the husband against the order and decree dated 26.5.2009 in F.C.O.P. No.397 of 2008 on the file of the Judge, Family Court, Nellore, granting maintenance to the wife.

  2. Mr.G.Venkateswarlu, learned counsel representing Mr.Tennepalli Niranjan, learned counsel for the appellant in FCA No.233 of 2008, who is the respondent in FCA No.173 of 2009, submits that the husband was killed by the wife and others on 28.5.2015 and in that case the wife was convicted for the offence under Section 302 of IPC and undergoing imprisonment. Except the said submission, learned counsel has not filed any copy of the judgment or death certificate.

  3. Recording the said submission, the Family Court Appeals are dismissed. Miscellaneous petitions pending, including I.A. Nos.1 of 2015 filed in both the appeals, shall stand closed.
