WHEREAS the petitioner has presented under Sections 10 to 12 of the Contempt of Courts Act, 1971, the above case through her counsel Sri V.V.N. Narayana Rao, praying the High Court to punish the Contemnors/respondents herein, for their willful and wanton violation of the orders dated 09-10-2020 passed by the Hon'ble Court in W.P.No. 18179 of 2020, in the interest of justice.
WHEREAS the said case coming on for hearing, and whereas the High Court, upon perusing the affidavit filed therein, the earlier orders of the High Court dt. 12-02-2021 and 17-09-2021 made herein and upon hearing the arguments Sri V.V.N. Narayana Rao, Advocate for petitioner and of Sri G.L. Nageswar Rao, Advocate representing respondents, made the following Order:-
Heard Mr. V.V.N. Narayana Rao, learned counsel for the petitioner.
It is stated by Mr. G.L. Nageswara Rao, learned Government Pleader for Revenue appearing for the respondents, that despite his specific instructions, the concerned Officer has attended his office without getting the record pertaining to the order dated 23.12.2020, which was directed to be produced before this Court by an order dated 01.10.2021. The Government Pleader also submits that he was informed by the District Registrar that the record directed to be produced by this Court would be made available.
However, neither the Officer, Mr. M. Sudhakar, who was present before this Court on the earlier occasion, is present, nor the record is placed before this Court as per the directions dated 01.10.2021.
The Government Pleader submits that he is giving up his vakalat in this matter.
When a direction was given by this Court to produce the record, it is for the respondents to make available the record for perusal of this Court and the District Registrar being superior to the Sub-Registrars is also required to ensure that the order of this Court is duly complied with. It is not known as to under what circumstances, the record is not placed before this Court and this Court. perhaps, has to take a serious view in the matter and draw an adverse inference that with a view to flout the orders of this Court dated 09.10.2020, the record has not been willfully produced before this Court.
However, with a view to give an opportunity, list this case on 23.10.2021.
The Registry is directed to implead the District Registrar, Stamps & Registration, Kakinada, East Godavari District, as respondent No.3 in the contempt case.
Respondent No.1 and newly impleaded respondent No.3 shall appear before this Court on the next date fixed, along with the record pertaining to the proceedings No.G1/1206/2020 dated 23.12.2020."
