HON'BLE Ms. JUSTICE B.S.BHANUMATHI CRIMINAL PETITION No.983 OF 2023 ORDER:
Ms R.Manju, learned counsel representing Sri Chalasani Ajay Kumar, learned counsel for the second respondent submitted that the relief in this criminal petition has become infructuous, as this petition is filed for quashing the proceedings in Crime No.643 of 2022 dated 09.07.2022, whereas the same was already registered as C.C.No.4362 of 2022 dated 12.09.2022 even by the date of filing of the criminal petition dated 02.02.2023. However, the learned counsel for the petitioners sought some more time for instructions and requested to extend the interim order.
In view of the above circumstances submitted by the learned counsel for the second respondent, the unimpeachable facts indicate that the relief has become infructuous and extension of the interim order is not required. However, it is open for the petitioners to take appropriate proceedings as per law, if aggrieved by the proceedings in C.C.No.4362 of 2022.
Accordingly, the criminal petition is dismissed as infructuous, however, giving liberty to the petitioners to avail remedies as per law.
Pending miscellaneous applications, if any, shall stand closed.
