TUESDAY, THE TWENTY NINETH DAY OF OCTOBER TWO THOUSAND AND TWENTY FOUR
PRESENT
THE HONOURABLE SRI JUSTICE RAVI CHEEMALAPATI
WRIT PETITION NO: 3220/2021
Between:
B Roopa @ Achamma
...PETITIONER
...RESPONDENT(S)
AND
State Of Andhra Pradesh and Others
Counsel for the Petitioner:
1 O MANOHER REDDY
Counsel for the Respondent(S):
1.GP FOR REVENUE
The Court made the following Order:
The short grievance of the petitioner is non-consideration of her application dated 11.11.2020 for mutation and issuance of E-Pattadar Passbook and Title Deed in her favor in respect of her land in an extent of Ac.5.60 cents in Survey No.109-2 of Cherlopally Village, Penukonda Mandal, Anantapuram District.
-
Heard Sri P.Sravan Kumar, learned counsel representing Sri O.Manoher Reddy, learned counsel for the petitioner and Sri Raghu, learned Assistant Government Pleader for respondents.
-
Learned counsel for the petitioner in elaboration to what has been stated in the affidavit submitted that for obtaining pattadar passbook and title deed, petitioner made an application on 11.11.2020, as the same was not considered.
The learned counsel for the petitioner further submitted that the said application was not considered on the ground that the SLP is pending before the Hon'ble Apex Court and now the Hon'ble Apex court has disposed of the said SLP. Even though, the said SLP has been disposed of, the respondents are not considering the petitioner's application dated 11.11.2020. It would suffice for the time being if a direction is given to the respondents concerned to consider and dispose of the petitioner's application in accordance with law in a time bound manner.
- On the other hand, learned Assistant Government Pleader submitted that, he has no instructions whether the SLP is disposed of or not. If the SLP is disposed of, the authorities would consider and pass the orders on the petitioner's application in accordance with law.
2
-
Non consideration of the petitioner's application for issuance of the pattdar passbook and title deeds is the grievance of the petitioner.
-
The petitioner contention is that her application was kept pending as the SLP with regard to the subject property is pending before the Hon'ble Apex Court. It was stated that, now the SLP is disposed of. The learned Assistant Government Pleader contended that he has no instructions regarding disposed of SLP.
-
In view of the above, taking the submissions of both the learned counsel into consideration, this Court is inclined to dispose of the Writ Petition, by passing the following order:
The Tahsildar concerned is directed to consider and dispose of the petitioner's application dated 11.11.2020 in accordance with law by duly verifying about the pendency of the SLP, and if the SLP is disposed of, the petitioner application shall be considered in accordance with law as expeditiously as possible within a period of twelve (12) weeks from the date of receipt of copy of this Order.
- Accordingly, this writ petition is disposed of. There shall be no order as to costs.
