THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY

WRIT PETITION No.2713 OF 2022

ORDER:-

This writ petition for a Mandamus is filed to declare the action of 3rd respondent-Sub-Inspector of Police, Nuzvid Town Police Station, in interfering in the civil dispute between the petitioner and 4th respondent and in insisting the petitioner to pay amount to the 4th respondent by calling him to the police station, as illegal, arbitrary and without jurisdiction and consequently sought direction to the 3rd respondent not to interfere in the civil dispute between the petitioner and 4th respondent.

  1. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents 1 to 3.

  2. Learned Assistant Government Pleader for Home on written instructions would submit that on the report lodged by the 4th respondent against the petitioner, that a case in Crime No.111 of 2022 was registered in Nuzvid Town Police Station for the offences punishable under Sections 420 and 506 of I.P.C. and the same is being investigated by the 3rd respondent. He would submit that except registering the said crime and investigating the same, the 3rd respondent never interfered in any such civil dispute between the petitioner and 4th respondent and that he never insisted the petitioner to pay money to the 4th respondent by calling him to the police station and the allegation made to that effect if absolutely false.

  3. Therefore, recording the aforesaid submission of learned Assistant Government Pleader for Home made on instructions that the 3rd respondent is not interfering in any such civil dispute between the petitioner and 4th respondent and that he is not insisting the petitioner to pay money to the 4th respondent by calling him to the police station, this Writ Petition is closed. There shall be no order as to costs.

However, as regards the crime that was registered against the petitioner, the law has to take its own course.

As a sequel, miscellaneous petitions, if any pending, in this Writ Petition, shall stand closed.
