Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue appropriate writ, order, direction, more particularly one in the nature of Writ of mandamus declaring the action of the respondents in not promoting the petitioner as Assistant Director along with Ch. Siva Narayana and N. Gowri Prasanna as per<br>the order dated 22-12-2023 of the 2^nd respondent as arbitrary and violative of Articles 14 and 16 of the Constitution of India and consequentially direct the respondents to promote me to the post of Assistant Director with all consequential and attendant benefits, grant costs of the proceedings.

IA NO: 1 OF 2024

Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondents to consider the petitioner's case for promotion as Assistant Director of insurance as and when vacancies arise, pending disposal of W.P.No.2372 of 2024, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri Y.D. Sagar, Learned Counsel appearing on behalf of Sri M. Pitchaiah, Learned Counsel for the Writ Petitioner and Sri S. Raju, Learned Assistant Government Pleader for Services-I appearing for Respondent No.1, the Court made the following.

ORDER:

Heard Sri Y.D. Sagar, Learned Counsel appearing on behalf of Sri M. Pitchaiah. Learned Counsel for the Writ Petitioner and Sri S. Raju, Learned Assistant Government Pleader for Services-I appearing for Respondent No.1.

2. It transpires from the Cause-title that the full and complete address of Respondent No.2 has not been furnished by the Counsel for the Writ Petitioner. Learned Counsel for the Writ Petitioner is directed to do the needful within one week

3. On furnishing of the full and complete address of Respondent No.2, Counsel for the Writ Petitioner is directed to take out Personal Notice in respect of Respondent No.2 within one week from today and file proof of receipt of Notice within a week thereafter.

4. Let Counter Affidavit be filed within three weeks. Two weeks thereafter for filing Re-joinder, if any.

5. Writ Petitioner is given liberty to make a fresh Representation to Respondent Nos.1 and 2. Upon receipt of Representation from the Writ Petitioner, the Respondent Nos.1 and 2 are directed to dispose of the same by passing a Speaking Order within four weeks thereafter and communicate such Order to the Writ Petitioner.

6. List the matter on 26.02.2024.
