HON'BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA
WRIT PETITION No. 1945 of 2023
ORDER:
This writ petition is filed by the petitioners under Article 226 of the Constitution of India for the following reliefs:
"...to issue a Writ or order or direction more particularly in the nature of Writ of mandamus declaring that the impugned action of the respondents in not paying of full back wages with effect from the date of illegal termination orders dated 17.12.2019 to the date of reinstatement into service i.e., 17.05.2021 is illegal, arbitrary, unjust and violative of Article 14, 16 and 21 of Constitution of India, contrary to law laid down by the Apex Court in a catena of decisions, consequently direct the respondents to pay full back wages with continuity of service with effect from 17.12.2019 to 17.05.2021 with all consequential benefits with interest and pass such other order or orders as may be deemed fit and proper in the circumstances of the case." Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration appearing for respondent Nos.1, 3 & 4, learned Government Pleader for Finance and Planning appearing for the 2nd respondent and learned standing counsel appearing for respondent Nos.5 & 6.

After arguing for some time, learned counsel for the petitioners mainly submits that a direction may be given to the respondents to consider the petitioners' representations dated 15.02.2022 and 29.03.2022 submitted to the 6th respondent.

Learned standing counsel for respondent Nos.5 & 6 submits that the 6th respondent will consider the petitioners' representations dated 15.02.2022 and 29.03.2022 in accordance with law, within a reasonable time.

Learned Government Pleader for Municipal Administration and learned Government Pleader for Finance and Planning does not refute the submission made by learned standing counsel.

Having regard to the submissions made by both the learned counsels and in the facts and circumstances of the case, without going into the merits of the case, the Writ Petition is disposed of with a direction to the 6th respondent to consider and dispose of the petitioners' representations dated 15.02.2022 and 29.03.2022, in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order. No order as to costs.
