ORDER (ORAL)

Dt: 09.03.2022

(per Prashant Kumar Mishra, CJ)

This Writ Petition has been preferred seeking a writ of mandamus to declare the order of respondent Nos.1 and 2 in denying the petitioner to appear and argue in person before this Court in Crl.R.C.(SR).Nos.12454 of 2018 and 16294 of 2018 as arbitrary and consequently, to pass an order permitting him to appear and argue in person in both the cases.

  1. Mr. Sugan Chandra Gupta, party-in-person, would submit that he has also appeared before the Hon'ble Supreme Court in S.L.P.(Civil) Diary Nos.9815 of 2018 and 32712 of 2018.

  2. After hearing the party-in-person for sometime and having regard to the fact that he was allowed to appear in person before the Hon'ble Supreme Court to represent his cases, we are of the considered opinion that he can be permitted to appear as party-in-person before this Court in Crl.R.C.(SR).No.12454 of 2018 and 16294 of 2018. Therefore, the petitioner is permitted to appear in person in both the cases.

  3. Accordingly, the Writ Petition is allowed. No costs. Pending miscellaneous applications, if any, in this Writ Petition shall stand closed.
