WRIT PETITION No.2893 of 2022 ORDER:

The petitioner seeks writ of mandamus declaring the action of the respondents in seizing the vehicle TATA Hitachi JCB EX 210 LC Super Plus without following any procedure as illegal and arbitrary and for a consequential direction to release the seized vehicle.

When the matter is taken up for hearing, learned Assistant Government Pleader for Home, on instructions, would submit that the police of Vedullapalli Police Station, Guntur District, filed Form – 60 before the learned Additional Civil Judge Court, Bapatla on 16.11.2021.

In view of the above submission, this writ petition is disposed of giving liberty to the petitioner to approach the concerned court and file suitable application for release of the seized vehicle, in which case, the learned Additional Civil Judge shall consider the said application and after hearing both parties, pass an appropriate order on merits in accordance with the governing law and rules, expeditiously but not later than three days from the date of filing of the application. No costs. As a sequel, interlocutory applications, pending, if any, shall stand closed.
