IN THE HIGH COURT OF ANDHRA PRADESH :: AMARAVATI
THE HON'BLE SRI JUSTICE B KRISHNA MOHAN
WRIT PETITION No.1564 of 2023
Smt. K. Radhamma W/o Raghunadha Reddy, aged 45 years, Occ: Agricuture R/6. Perumallapalli Village, Yadamari Mandal, Chittoor District.
…. Petitioner
Versus
The State of Andhra Pradesh, rep. by its Secretary, Revenue Department, Secretariat, Velagapudi, Guntur District and 4 others.
….Respondents
ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for the respondents.
-
The grievance of the writ petitioner is that, her representation dated 25.01.2022 has not been considered by the respondent Nos.4 and 5 for correction of the Survey Number as 942/1 instead of 941/1 for an extent of Acres 2.50 cents situated at Perumallapalli Village, Yadamari Mandal of Chittoor District.
-
The learned counsel for the petitioner submits that the petitioner is in continuous possession and enjoyment of the land in Survey No.942/1 (D-Form Patta shows Survey No.941/1) for an extent of Acres 2.50 cents situated at Perumallapalli Village, Yadamari Mandal of Chittoor District by virtue of D-Form-7 patta granted by the 4th respondent dated 05.11.2007. There is no dispute with regard to the issuance of patta and possession of the petitioner over the subject land. On the application of the third party by name one Smt. B. Ratnamma, the 5th respondent conducted survey and found that the petitioner's land was situated in Survey No. 942/1 but not in Sy.No. 941/1. Thus, the 5th respondent finds that the survey number earlier given to the petitioner is a wrong one, which requires correction in the pattadhar passbook. Hence, for the purpose of carrying out the correction in the revenue records with respect to the above said survey number, the petitioner made a representation on 25.01.2022 but the same is not acted upon so far.
-
On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that, if an application is made by the petitioner by following the procedure, the same would be considered by the respondent Nos.4 and 5 by following the due procedure.
-
In view of the above said facts and circumstances, the petitioner is permitted to make an online application through
2
Village Secretariat within a period of two (02) weeks from the date of receipt of copy of this order for correction of the survey number if any, with respect to her land in possession. On receipt of such application from the petitioner, the respondent Nos.4 and 5 shall consider and dispose of the same strictly in accordance with law as expeditiously as possible preferably within a period of three (03) months thereafter. While, deciding the application of the petitioner by the authorities, all the parties shall be heard and any survey shall be conducted in the presence of all the parties concerned by giving due opportunity and then only necessary corrections can be made in the revenue records.
- Accordingly, the writ petition is disposed of. There shall be no order as to costs.
As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
