Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondent Nos., 3 and 4 to remove the encroachments/constructions and to maintain Bade Saheb Tank, being an extent of Ac.12.80 cts in R.S.No.1045 of Vuyyuru Nagar Panchayat, Krishna Dt., vide the proceedings Rc.B.192/2019, Dt.30.08.2019, pending WP and pass, Pending disposal of WP 1845 of 2021, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri V. S. R. Anjaneyalu Advocate for the Petitioner, GP for Revenue for the Respondent Nos.1 to 3, Sri M. Manohar Reddy, Standing Counsel for Respondent No.4 and of GP for Home for Respondent Nos.5 & 6, the Court made the following.

ORDER

learned counsel for the petitioner, Heard learned Assistant Government Pleader for Revenue and Sri M. Manohar Reddy, learned Standing Counsel for 4^th respondent.

The Writ Petition is filed interalia seeking a direction to the respondent Nos.3 and 4 to remove the illegal constructions in the Bade Saheb Tank which is situate in Vuyyuru Nagar Panchayat, Krishna District.

Learned counsel for the petitioner while re-iterating the contentions raised in the Writ Petition submits that despite the communications in this regard, including the one dated 30.08.2019 by the 3rd respondent dated 30.08.2019 to the 4^th respondent, no action has been taken so far. As a result of the same, the said tank is being further encroached upon and the construction of houses are being carried on. He submits that unless interim relief sought for in the present Writ Petition is granted to take action pursuant to the said communication, further encroachments would take place and the extent of the tank would be reduced.

Learned Standing Counsel on the other hand submits that there is no regular Commissioner for the 4^th respondent as per his oral instructions and the R.D.O., Gudivada is holding additional charge. He submits that appropriate instructions would be obtained from the concerned and a detailed counter would be filed if some time is granted.

However, considering the submissions made by the learned counsel for the petitioner and perusing the communication dated 30.08.2019, the 4^th respondent is directed to take appropriate action on the same within a period of eight (8) weeks and file a report before this Court on the action taken.
