Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the respondents 4 and 5 herein in interfering with the peaceful possession and enjoyment of the petitioners property of land in Sy. Nos. 1099/11 and 1099/5 total admeasuring Ac.0-70 cents situated at Patnam Village, Thavanmpalle Mandal, Chittoor District as illegal, arbitrary, high handedness and against the principles of natural justice and violative of Articles 14 and 300-A of Constitution of India and consequently direct the respondents 2 to 5 herein to remove the Board showing as Government land in the lands of petitioner.

Nos.1099/11 and 1099/5 total admeasuring Ac.0-70 cents situated at Patnam Village, Thavanmpalle Mandal, Chittoor District bounded on North : Bandi Bata (Road for Land); South : Land of A. Swapna; East : Land of Gnanashekar Naidu; West : NH-140 Mallavaram to Iruvaram Road; Pending disposal of WP 1739 of 2021, on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri B N Swamiji Advocate for the Petitioner, and of GP for Revenue for the Respondents and the Court made the following.
ORDER:
"Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue, who seeks time to file counter in the matter.
However, considering the submissions made by the learned counsel for the petitioner that the respondents are trying to dispossess the
petitioner from the subject matter property, there shall be a direction to the respondents not to dispossess the petitioner from the land in question without following due process of law.
List the matter after three (3) weeks."
