THE HON'BLE SMT JUSTICE LALITHA KANNEGANTI TRANSFER C.M.P.No.14 OF 2020

ORDER:

This transfer petition is filed seeking to withdraw O.P.No.162 of 2018 from the file of the Court of I Additional Senior Civil Judge at Rajahmundry, East Godavari District and transfer the same to the file of the Family Court at Visakhapatnam, Visakhapatnam District.

  1. The marriage between the petitioner and respondent was performed on 08.07.2017 at Venkateswara Swamy Temple, Thatikonda. In view of the differences between the parties, the petitioner has filed a complaint before the police, which was numbered as Crime No.14 of 2019 for the offences punishable under Section 498-A I.P.C. and Section 4 of the Dowry Prohibition Act on 11.01.2019. Subsequently, she also filed D.V.C.No.51 of 2019 on the file of the Court of I Additional Chief Metropolitan Magistrate, Visakhapatnam. While things stood thus, the respondent has filed O.P.No.162 of 2018 on the file of the Court of I Additional Senior Civil Judge, Rajahmundry, East Godavari District, for dissolution of marriage between him and the petitioner.

  2. Heard learned counsel for the petitioner.

  3. None appeared for the respondent.

  4. Learned counsel for the petitioner submits that the petitioner is staying along with the parents in Visakhapatnam. When the distance between Visakhapatnam and Rajahmundry is about 230 K.M. and she has a child aged about 4 years, it is very difficult for her to travel from Visakhapatnam to Rajahmundry leaving her child at her parents'

house and in view of the financial difficulties, it is not possible for her to travel from Visakhapatnam to Rajahmundry.

  1. Taking into consideration the fact that the petitioner is staying along with her parents in Visakhapatnam and distance between Visakhapatnam and Rajahmundry, this Court deems it appropriate to withdraw O.P.No.162 of 2018 from the file of the Court of I Additional Senior Civil Judge at Rajahmundry, East Godavari District and transfer the same to the file of the Family Court at Visakhapatnam, Visakhapatnam District.

  2. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. O.P.No.162 of 2018 is withdrawn from the file of the Court of I Additional Senior Civil Judge at Rajahmundry, East Godavari District and transferred to the file of the Family Court at Visakhapatnam, Visakhapatnam District. There shall be no order as to costs.

Consequently, Miscellaneous Applications pending, if any, shall stand closed.
