Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more in the nature of Writ of Mandamus to declare the proceedings vide C.No.A8/14287 and 14336/2019 dated 19.02.2020 on the file of the 4threspondent in rejecting the claim of the petitioners for sanction of increment under Automatic Advancement scheme for 6 and 12 years by counting the past service rendered in the category of Police Constable in the APSP department i.e. service rendered prior to the selection of Police Constable Civil and effecting recovery of increment sanctioned after 6 years of service under Automatic Advancement which was paid long back as illegal, arbitrary, discriminatory and against Article 14,16 and 21 of the Constitution of India, against the Rule 22 (a)(iv) of Fundamental Rules and also contrary to the Hon'ble Apex Court judgment passed in Civil Appeal No. 11527 OF 2014 and batch dated 18.12.2014 and set aside the same and consequently direct the respondents to sanction increments under Automatic Advancement scheme for 6 and 12 years by counting the past service rendered in the category of police constable in the APSP department.

IA NO: 1 OF 2021

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to stay of recovery of increments already sanctioned for 6 years under Automatic Advancement by suspending the proceedings vide C.No. A8/14287 & 14336/2019 dated 19.02.2020 pending disposal of WP 1502 of 2021, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri S.Harinath Reddy Advocate for the Petitioners and of GP for Services I for the Respondents, the Court made the following.

ORDER:

At the request of learned Government Pleader for Services-I to get instructions, post the

matter after two $(02)$ weeks.

Meanwhile, there shall be an interim stay of recovery of amount paid to the petitioner by

way of automatic career progression in proceedings vide C.No.A8/14287 & 14336/2019, dated

19.02.2020, as the amount already paid cannot be recovered by issuing impugned proceedings

prima facie in view of the law laid down by the Apex Court in the case of State of Punjab &

Ors Vs Rafiq Masih (White Washer)¹ wherein the Apex Court held in Para 12 as follows:-

"It is not possible to postulate all situations of hardship, which would govern employees on the issue of recovery, where payments have mistakenly been made by the employer, in excess of their entitlement. Be that as it may, based on the decisions referred to herein above, we may, as a ready reference, summarise the following situations, wherein recoveries by the employers, would be impermissible in law:

(i) Recovery from employees belonging to Class-III and Class-IV service (or Group 'C' and Group 'D' service);

(ii) Recovery from retired employees, or employees who are due to retire within one year, of the order of recovery;

(iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued;

(iv) Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post, and has been paid accordingly, even though he should have rightfully been required to work against an inferior post."

By applying the same principles to the present facts of the case, the impugned proceedings C.No.A8/14287 & 14336/2019, dated 19.02.2020 for recovery is suspended for a period of four $(04)$ weeks.

Post the matter after three $(03)$ weeks.
