.THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.1248 of 2020

ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue any writ or direction or order more particularly in the nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in seizing the vehicle car bearing number TN 07 BT 1094 of petitioner without following procedure prescribed under law as illegal, arbitrary and violative of Articles 19 and 21 of the Constitution of India and consequently directing Respondents 2 and 3 to release the car bearing number TN 07 BT 1094 to petitioner in the interest of justice."

At the stage of admission, learned counsel for the petitioner fairly conceded that no application is filed before respondent No.2 for release of the car bearing No.TN 07 BT 1094.

Learned Government Pleader for Forests requested to direct the petitioner to file an application for release of the vehicle and requested to pass appropriate order.

Therefore, the petitioner is directed to file appropriate application before respondent No.2 for release of the vehicle, on filing such application, respondent No.2 is directed to dispose of the same, in accordance with law, within two (2) weeks from today.

With the above direction, the writ petition is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
