WHEREAS the Petitioner above named through its Advocate SRI K.A.S.V. Prasad, presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue any order or direction more particularly one in the nature of Writ of Mandamus or any other appropriate writ or order or direction declaring (a) the Order of detention Proceedings of the 1st respondent, in FORM GST MOV-06 dated 31.12.2022 for want of E-Invoice (Annexure P-1) without considering the letter of Objections dated 29.12.2022 sent through mail and physically filed on 30.12.2022 (Annexure P72) in reply to the Notice inform MOV-02 dt 28.12.2022 (Annexure P-3) and also for not releasing the consignment even after found 'no variation' on Physical verification report made available in Form MOV-04 dt 28.12.2022(Annexure P-4) is against to circular instruction of the CBEC (GST Policy Wing) at para 2(g) Circular No 41/15/2018-GST dated 13.04.2018(Annexure P-5), and to the Rule 138(1) R/w Sec.129(1) of the AP State Goods and Service Tax Act 2017, and also against to all cannons of justice as arbitrary, without jurisdiction, against to the principles of natural justice and contrary to the Sec.129(3) of the AP State Goods and Service Tax Act 2017, (herein after referred to as 'the Act') (b) to declare the 1st respondent as not the 'proper officer' notified U/Sec 4 of the IGST_Act, 2017 to enquire the export transaction as arbitrary,

without jurisdiction, against to the principles of natural justice and the proceedings of the 1st respondent is liable to be set aside void ab initio.

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri K.A.S.V. PRASAD, Advocate for the Petitioner and of the Govt. Pleader for Taxes for respondent Nos. 1 and 2 and of Sri Suresh Kumar Routhu, Senior Standing Counsel for respondent Nos. 3 and 5 and of Smt Vijaya Kumari, Standing Counsel for respondent No.4, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.
