WHEREAS the Petitioner above named through his Advocate Sri.P.Jagadish Chandra Prasad presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the impugned action of the respondents in interfering with petitioner possession and enjoyment of the property situated in S.No 230/3 of an extent of Ac 1.46 Cents situated at Nelavoy Village, S.R.Puram Mandal, Chittoor District and to declare the action of respondents as illegal, arbitrary, unconstitutional and being violative or articles 14, 21 and 300(A) of the constitution of India and in violation of principal of natural justice and consequently direct the respondents to not to interefere in to petitioner peaceful possession and enjoyment of the property situated in S.No 230/3 of an extent of Ac 1.46 Cents situated at Nelavoy Village, S.R.Puram Mandal, Chittoor District in the interest of Justice;

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri.P.Jagadish Chandra Prasad Advocate for the Petitioner and of GP for Revenue for Respondent Nos.1 to 4, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.

You viz:

    1. The Additional Commissioner, Rajamandravaram Municipal Corporation Rajamahendravaram, East Godavari District
    1. The Revenue Divisional Officer, Chittoor, Chittoor District
    1. The Mandal Revenue officer, S.R.Puram , S.R.Puram Mandal, Chittoor District.4. The Principal Secretary, Revenue Department, State of Andhra Pradesh, A.P.Secretariat, Amaravathi

are directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and the affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted before 08.02.2021, on which date the case stands posted for hearing.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to not to interfere in to petitioner peaceful possession and enjoyment of the property situated in S.No 230/3 of an extent of Ac 1.46 Cents situated at Nelavoy Village, S.R.Puram Mandal, Chittoor District in the interest of Justice, pending disposal of the Writ Petition No. 623 of 2021, on the file of the High Court.

Notice before admission.

A perusal of the material on record shows that latest adangals reflect the name of the petitioner in respect of the subject property.

In view of the above, there shall be an interim direction to the respondents not to interfere with the possession of the petitioner in respect of the subject property, without following due process of law, till the next date of listing

List after four weeks.
