Petition under Section 480 & 483 of BNSS, 2023 is filed praying that in the circumstances stated in .memorandum of grounds of Criminal Petition, the High Court may be pleased to release the petitioner on bail in connection with Crime No.420/2024, dated 06-12-2024 of GRP Police Station, Vishakapatnam;

This Criminal Petition is filed under Section 480 and 483 of the BNSS, seeking to enlarge the petitioner herein/sole accused on bail in Crime No.420 of 2024 of Government Railway Police Station, Visakhapatnam District registered for the offence punishable under Sections 20(b)(ii)(B) read with 8(c) of the NDPS, Act.

  1. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the Respondent-State.

  2. Perused the material on record.

  3. Upon hearing of learned counsel on both sides and on perusal of the record, it is seen that the present crime was registered on 06.12.2024 and 17.3Kgs of Ganja was recovered from the possession of the petitioner herein. He has been in judicial custody since o6.12.2024 and best part of the investigation is over. It is relevant to note that, what was seized was not commercial quantity.

  4. Considering the length of detention and the quantity of contraband involved, as it is not comes under the purview of

commercial quantity, this Court is of the opinion that any further detention does not seem necessary. Hence, the prayer is granted.

  1. ln the result, this Criminal Petition is allowed, with the following condl'tions:

(i) The petitioner herein shall be released on executing a Personal bond for Rs.15,000/-(Rupees Fifteen Thousand only) with two sureties for a like sum each to the satisfaction of the learned vI Additional Judicial Magistrate of First Class for Railways-Gum-V[ Additional Civil Judge Court, Visakhapatnam.

(ii) On release, the petitioner shall appear before the station House Officer, concerned, once in a week i.e., on every sunday between 10.00 a.m. and 01.00 p.m., for a period of three (3) months.

(iii) The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses.

Miscellaneous petitions, if any pending, in the criminal petition, shall stand closed.
